RESOLUTION 1999-4
WHEREAS,
according to the Declaration of Trust
agreement, executed by Andrew Carnegie for legal establishment of the
Andrew Carnegie Free Library exactly one hundred years ago:
"…it is the expressed wish of the said ANDREW CARNEGIE that the
management and control of such library, buildings and appurtenances, and
all matters and things appertaining thereto, shall devolve upon a
Commission, or Board of Trustees,…"
Thus, the Library's Board of Trustees, only, makes official
decisions appertaining to the Andrew Carnegie Free Library;
AND, WHEREAS, from time to time, for the efficient and
expeditious performance of Trustee duties, it becomes necessary for a
Library Trustee to make a request of a member of the Library Staff,
without prior approval of the Board of Trustees;
AND, WHEREAS, the Board of Trustees wishes to ensure that such
requests are proper, and that such requests do not present an unfair
burden on the Library Staff.
NOW, THEREFORE BE IT RESOLVED:
- The Library Director shall comply with all resolutions and
directives approved by the Library Board of Trustees. Further, the
Library Director shall comply with all applicable Federal and State laws
and regulations, and all applicable County and Municipal Ordinances. The
Library Director shall be responsible for ensuring that all Library Staff
members, including members of the Volunteer Staff, comply with all of the
items listed in the first two sentences of this section.
- Any request by a Library Trustee, of any member of the Library Staff,
not previously approved by the Board of Trustees, must be made in writing
to the Library Director, or the Library Director's appointed surrogate,
and signed by the Trustee making the request. A Trustee Request Form can
be used to expedite such a request. The Library Director shall maintain a
file of all such Trustee requests. Any Library Trustee, upon verbal
request to the Library Director, shall be permitted to inspect this file.
The Committee on Library shall review this file, at least, on an annual
basis. The Library Staff is hereby directed to consider, only,
Library Trustee requests presented in writing and approved by the Library
Director, or the Library Director's appointed surrogate.
- The Library Director, or the Library Director's appointed surrogate,
receiving such a written request from a Library Trustee, shall date the
request and give due consideration to the request. Should the Library
Director, or the Library Director's appointed surrogate, find it necessary
not to comply with a certain request, a written explanation of their
decision shall be issued, within forty-eight(48) hours of the receipt of
the request, to the Library Trustee making the request; copies of this
explanation(along with a copy of the original request) shall be delivered
to the Library Board President, and a copy shall be placed in the said
file of Trustee requests.
No copy of the original request, nor a copy of the denial of such
request, shall be placed in a Library employee's personnel file, without
approval of the Board of Trustees. No disciplinary action, for an
employee's denial of a Trustee request, shall occur, without approval of
the Board of Trustees; nor shall such a denial be considered during an
official evaluation of the staff member.
- Requests of the Library Staff, made by a member of the Library's
Advisory Board, must be channeled through the Library Board of Trustees.
If such a request is of an urgent nature, the Library Director, or the
Library Director's appointed surrogate, shall have the discretion to
consider such a request under the same conditions as that of a request of
a Library Trustee.
5) Following approval by the Library Board of Trustees, copies of
this Resolution shall be distributed to all Library Trustees, Advisors,
and employees. A copy of this resolution shall be posted, at all times,
on or near the Staff Bulletin Board.
